Trans director Sam Feder's latest documentary "Heightened Scrutiny" presents a moving two-part perspective – simultaneously an emotional profile of a key trans advocate and a critical analysis of journalistic coverage surrounding transgender rights.

Legal Battle at the Supreme Court

This documentary follows ACLU lawyer Chase Strangio as he prepares for legal presentations in the significant Supreme Court case the Skirmetti case. This legal battle took place in late 2024, with the judiciary eventually ruling in support of the state's argument, practically permitting restrictions on healthcare for transgender young people to remain in place across numerous US territories.

We produced Heightened Scrutiny in just 16 months, explained Feder during a discussion. Meanwhile, my earlier film Disclosure took me half a decade, so this was very accelerated. Our goal was to raise conversation so people would learn more about the case.

Human Narrative Amid Legal Battle

While Feder provides a extensive critique of how major publications have promoted transphobic talking points, the film's primary achievement may be its captivating portrayal of Strangio. Typically a reserved lawyer in media settings, Strangio reveals his vulnerability throughout the production.

That was a substantial challenge, to open up parts of my life to a documentary crew that I had strived to keep private, stated Strangio. Sam said he wanted the next generation to know that we struggled, to see what was done in defense of these fights for our basic existence.

To strengthen Strangio's narrative, Feder includes numerous transgender activists, including respected figures from journalism and entertainment. This ink moment is one of my favorites in the movie, stated Strangio. Being tattooed is almost like a meditative process for me, to be fully present in my body and to think of it as a vehicle for things that are important to me.

Physical Autonomy and Portrayal

Feder's attention to carefully documenting Strangio adding to his body art highlights that Heightened Scrutiny is essentially about trans bodies – not just those of youth who face restriction of their right to live genuinely in their own bodies, but also the bodies of the many interviewees who are featured in the production.

I produce films with a meaning, and part of that is selecting people who are brilliant and articulate enough to sustain the camera, stated Feder. When people ask me what they should wear for an interview, my reply is whatever makes you feel confident. This is important to me – as trans people, we face challenges so much with our appearance.

Legacy and Optimism

A key aspect that makes Feder's works shine is his clear skill for making his trans participants feel respected, recognized and admired. This technique creates authentic connection between Feder and Strangio, enabling the director to accomplish his goal of presenting Strangio as a whole human being and providing a record for posterity of how persistently he and fellow activists have campaigned for trans rights.

I don't want people to end up in a state of perpetual hopelessness because of what the law is not giving us, explained Strangio. I aim to be in a practice of using the law to reduce harm, but not to turn it into some kind of pathway for our freedom possibilities. Official institutions is not going to be the mirror through which we see ourselves. Our community are that mirror, and it's really vital that we persist having that conversation together with discussions about fighting back these regulations and practices.
