A American border officer has declared in court he could sense through his protective gear the force of a deli item launched at him by a capital city activist, who has stood before a judge for criminal charge.

Customs and Border Patrol agent Gregory Lairmore informed the legal jury the snack "burst all over him" and he "could smell the aromatic vegetables and condiment" on his work clothing.

Neither side challenges that the accused, 37, did in fact lob vulgar language and a prepared food item at officers sent by the former president to patrol the federal district in the summer month.

The occurrence was recorded on recording and went viral, making the defendant a representation of opposition in the capital to the administration.

Federal attorneys initially tried to secure major offense allegations against the defendant, but a judicial committee refused to charge him.

The administration's sending of armed forces to the federal district this summer sparked protest from some of the local inhabitants, who considered it a partisan deployment of the armed forces.

According to court papers, the accused walked up to a law enforcement team at about late evening on the summer date, calling them "extremists" and shouting: "Why are you present? I don't want you in my city!"

The trial witnessed a re-enactment from Mr Lairmore on the trial day as he testified against the defendant.

"I could feel it through my protective gear," he said of the item's force, adding that an aromatic fragment remained from his police radio and mustard discolored his clothing.

Mr Dunn's lawyer, the defense attorney, said in her court presentation that throwing the food item was a "non-threatening act that did not, could not, create physical damage".

But government attorney the prosecutor maintained the accused must be held accountable.

"No matter who you are, you cannot simply hurling objects at people because you're angry," the attorney declared.

Subsequent to the reported incident was revealed, the defendant was dismissed from his position as a paralegal in the government law department.
